PeekProfit Terms of Service

These terms are an agreement between the merchant who installs the PeekProfit Shopify app ("you") and ME MORE COOL PTY. LTD. (ABN 45 611 538 697), trading as memorecool ("we", "us"). By installing or using PeekProfit you agree to them. Our Privacy Policy is part of these terms.

1. The service

PeekProfit reads your store's orders, products and settings through Shopify and calculates revenue, costs and profit from them and from the costs you enter or connect. Figures depend on the data Shopify and the services you connect provide and on the costs you set. PeekProfit is an analytics tool; it is not accounting, tax or financial advice.

2. Plans, trials and billing

  • Plans, prices, included orders and usage charges are shown in the app before you subscribe. Every plan starts with a free trial; a trial is used once per store.
  • Shopify bills the subscription and any usage charges on your Shopify invoice. Usage charges for orders above your plan's included amount never exceed the cap shown for the plan in each 30-day billing period.
  • You can change plans in the app or cancel at any time by uninstalling PeekProfit. Charges already billed are not refunded except where the law requires.
  • We may change prices with at least 30 days' notice; changes apply from your next billing period.

3. Your responsibilities

You are responsible for the costs and settings you enter, for having the right to connect the third-party accounts you connect, and for using PeekProfit in line with Shopify's terms and the law. Do not try to access other stores' data, disrupt the service, or reverse engineer it.

4. Data processing

For the personal information about your customers that PeekProfit handles, you are responsible for that information and we process it on your behalf. We will:

  • process it only to provide PeekProfit to you, as described in the Privacy Policy, and not sell it or use it for any other purpose;
  • keep it to the minimum the service needs (we keep the country of a shipping address and a salted one-way hash of the customer ID, not names, email addresses, phone numbers or street addresses);
  • protect it with encryption in transit and at rest, encrypted backups, access limited to the staff who need it, strong authentication, and a log of access to store data;
  • use only the service providers listed in the Privacy Policy, and tell you before adding one that receives store data;
  • help you respond to requests from your customers, which Shopify forwards to us, and delete customer data when Shopify asks us to;
  • tell you without undue delay, and within 72 hours of becoming aware of it, if a security incident affects your store's data, and notify the Office of the Australian Information Commissioner where the law requires;
  • delete your store's data when you uninstall PeekProfit, as set out in the Privacy Policy.

5. Third-party services

Shopify and the ad platforms and fulfilment services you connect are provided by others under their own terms. We are not responsible for their availability or for the accuracy of the data they provide.

6. Availability and changes

We work to keep PeekProfit available and accurate, but it may sometimes be unavailable for maintenance or because of problems outside our control. We may improve or change features; we will not remove a core feature of your paid plan during a billing period you have paid for.

7. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Otherwise, PeekProfit is provided as is, and to the extent the law allows our total liability to you for any claim is limited to the fees you paid us for PeekProfit in the 12 months before the claim, and we are not liable for indirect or consequential loss, including lost profits or decisions made on the basis of PeekProfit's figures.

8. Ending the agreement

You can end this agreement at any time by uninstalling PeekProfit. We may suspend or end your access if you seriously breach these terms or if we stop offering PeekProfit, in which case we will give reasonable notice where we can.

9. Changes to these terms

We may update these terms; the date above will change, and we will tell you about material changes before they take effect.
